Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before using gnomik.me (the “Service”), operated by Anonymous Santa Clauses, a project of Ugly Unicorn (“us”, “we”, or “our”).

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of them, you may not use the Service.

Eligibility

You must be at least 18 years old to use the Service. Some of its illustrations are cheeky and meant for grown-ups. By signing in you confirm that you are 18 or older.

The Service

The Service lets you host or join a secret gift-exchange party, randomly assigns each participant someone to give a gift to, and keeps those assignments private. The Service is provided for personal, non-commercial use.

Accounts

You sign in with a one-time link sent to your email address. You must provide an email address that is accurate and that you control. Anyone with access to your inbox can sign in as you, so keep your email account secure and tell us promptly if you suspect unauthorized use of your account.

You can change your email address, change your name, and delete your account from your profile page.

Parties and Your Content

You keep ownership of what you provide to the Service, such as your name, party names and wishlists (“Your Content”). You give us a limited licence to store and display it as needed to run the Service.

Participants in a party can see the party’s details and the names of the other participants. Nobody except you can see who you were assigned, and we do not reveal assignments to anyone else.

Hosts can delete a party. A deleted party is hidden from everyone and can be restored by its host for one day. After that it may be permanently removed.

Acceptable Use

You agree not to:

  • use the Service for anything unlawful, or to harass, threaten or impersonate anyone;
  • post content that is abusive, hateful or infringes anyone else’s rights;
  • attempt to access other users’ data, break or overload the Service, or interfere with its security;
  • use automated means to create accounts or parties, or to scrape the Service.

We may remove content or suspend accounts that break these rules.

Account Deletion and Termination

You may delete your account at any time from your profile page. Deleting your account removes it together with the parties you host that have not yet rolled the dice. See our Privacy Policy for how long data is kept.

We may suspend or terminate your access to the Service at any time, with or without notice, including if you breach these Terms. Provisions that by their nature should survive termination, including ownership, warranty disclaimers and limitations of liability, will survive.

Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We do not guarantee that emails will be delivered or that the Service will always be available. We are not responsible for gifts that are late, wrong, or exactly what the recipient mentioned last Tuesday.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

The Service may link to third-party sites that we do not own or control. We are not responsible for their content or practices, and we advise you to read their terms and privacy policies.

Governing Law

These Terms are governed by the laws of Canada and the province in which Ugly Unicorn is based, without regard to conflict of law provisions. Our failure to enforce a provision is not a waiver of it. If a provision is held unenforceable, the rest of the Terms remain in effect. These Terms are the entire agreement between us regarding the Service.

Changes

We may modify these Terms at any time. If a revision is material we will try to give at least 30 days’ notice before it takes effect. By continuing to use the Service after revisions take effect, you agree to the revised Terms. If you do not agree, please stop using the Service.
